Terms and conditions

These terms apply to the website design, development, hosting and maintenance services provided by Dalo Technology Services LLC ("we," "us," "our") under the name Dalo Build, and to your use of build.dalotechservices.com. "You" means the client or person using our services. By accepting a quote, paying an invoice or using our services, you agree to these terms.

Our services

We design and build websites, including pages, contact forms, booking calendars, online stores, admin dashboards and custom features, and we host and maintain them. The exact work for your project is described in your quote.

Quotes and payment for your build

• Prices shown on our website are starting prices. Your final price depends on the pages and features you need.
• We'll give you a written quote before work begins. The quote describes what's included, the price and the payment terms.
• Work outside the quote is charged separately, and we'll agree on the price with you first.

Revisions and approval

During your build, we share designs and a preview of your website, and make reasonable revisions within the scope of your quote. When you tell us you're satisfied with the website, or approve it for launch, the build is complete.

After that, major modifications are charged separately, depending on the modification and changes being made. Major modifications include rebuilding or redesigning the website, changing its layout or overall look, adding new features or sections, and adding many new pages. We'll give you a quote before starting.

Hosting and maintenance

Websites we build are hosted in our Cloudflare account. Hosting and maintenance costs $40 per month per website and includes:

• Hosting on Cloudflare's global network, with an SSL certificate
• Security updates and fixes
• Small updates, such as changing hours, prices, contact details, short text or photos
• Help by email

Requests larger than small updates are treated as major modifications, as described above.

We work to keep your website online at all times, but we can't guarantee uninterrupted service, because hosting depends on third-party providers and the internet. We're not responsible for outages caused by those providers.

Late or failed payments

Hosting and maintenance is billed monthly. If a payment fails or isn't made, we'll let you know. You have one month from the due date to pay. If payment still hasn't been received after one month, your website will be taken offline until the balance is paid.

Taking a website offline doesn't end our agreement or cancel amounts you owe. To end our services, see "Ending our services" below.

Your responsibilities

• Provide the content, information and approvals we need, on time. Delays on your side can delay your project.
• Make sure you have the right to use everything you give us, such as text, photos, logos and product images.
• Make sure your website's content and the way your business uses it follow the laws that apply to you, including laws about privacy, sales and the information your website collects.
• Keep the logins we give you, such as your admin dashboard sign-in, secure.

Ownership, code and data

• Your content and data belong to you. That includes your text, photos, logos, products, and the information your website collects.
• Your domain name should be registered in your name. We connect it to your website but don't own it.
• Your website's code is provided on request. Some websites use tools and components we've built for use across many client websites. When we provide your code, you may use those components as part of your website, but you may not resell or redistribute them separately.

Ending our services

If you no longer want to do business with us, you must give us notice in writing. An email to info@dalotechservices.com counts as written notice. After we receive it:

• We'll give you your website's data, and your website's code if you request it.
• Your website will be removed from our hosting after the handover, so arrange new hosting first if you want your website to stay online.
• Any amounts you owe for work or hosting up to the end date remain due.

We may also end our services by giving you written notice, for example if payments remain unpaid or these terms are broken. If we do, we'll give you your data in the same way.

Third-party services

Your website may rely on other companies' services, such as Cloudflare for hosting, a payment processor for online stores, or an email delivery service. Their own terms apply, and we're not responsible for their actions, outages or changes to their prices or features.

Acceptable use

We won't build or host websites that are illegal, fraudulent, infringe others' rights, spread malware, or send spam. We may take down content or suspend a website that breaks this rule, and we'll tell you why.

Disclaimers

We build every website with care and fix problems caused by our work. Beyond that, our services are provided "as is." We don't promise specific business results, such as search rankings, traffic or sales.

Limitation of liability

To the fullest extent permitted by law, Dalo Technology Services LLC is not liable for indirect, incidental or consequential damages, such as lost profits or lost business, arising from our services. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of Maryland, without regard to its conflict of law rules.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the "Last updated" date above and let current clients know about important changes. Continuing to use our services after changes take effect means you accept the updated terms.
